## Why this case is in the news

On Aug. 31, 2026, a Clark County jury found Davis, 63, guilty of first-degree murder with use of a deadly weapon in the 1996 killing of Tupac Shakur, after less than three hours of deliberation.[4][2] Prosecutors did not claim he fired the shots; they argued he supplied the gun and ordered the attack.[2] He faces a maximum of life in prison without the possibility of parole, and sentencing is set for Oct. 13, 2026.[6][4] Davis told the judge he would appeal, and he has since told an interviewer, "I'm innocent, man."[4][9]

## The backstory

### The fight at the MGM Grand

On the night of Sept. 7, 1996, Shakur and members of his entourage attended a Mike Tyson fight at the MGM Grand Garden Arena.[27] Afterward, Shakur, Marion "Suge" Knight, who ran Death Row Records, and members of their entourage beat Davis's nephew, Orlando "Baby Lane" Anderson, at the hotel.[27][2] Jurors saw casino security video of the fight.[11] Witnesses at trial described a hostile rivalry between two Los Angeles-area gangs, the Mob Piru and the South Side Compton Crips, which were tied to Death Row Records and Bad Boy Records.[3]

### The shooting

Las Vegas police said Davis obtained a gun from "a close associate" and got into a white Cadillac with Anderson and two other men.[25] Shakur was riding in a black BMW driven by Knight. A retired officer testified that he had stopped the BMW for having no license plate and let it go with a warning; about 10 minutes later he responded to the shooting.[14] The Cadillac pulled up beside the BMW at a red light near the Strip and gunfire erupted.[10] Shakur was shot multiple times and died six days later, at 25. Knight was grazed and survived.[10][14] A retired homicide sergeant told the grand jury that Shakur had four gunshot injuries.[22] At trial, a Las Vegas police officer testified that he examined seven cartridge cases and that only one weapon was used.[11]

The officer testified that when he asked Shakur in the ambulance who shot him, Shakur replied, "no, we'll take care of it."[14] For years, no one was charged in the killing.[2] Anderson, who denied involvement, died two years later in an unrelated gang shooting.[23][12] Police say the two other men in the Cadillac have also died, leaving Davis as the last living occupant.[27][2]

### Davis's own accounts

The case against Davis rested largely on what he said himself, over many years.[10] According to prosecutors, he spoke to the FBI in 1998 and 1999, placing himself in Las Vegas that night and, in 1999, denying responsibility.[14] The district court found that his 1998 statements were made under a federal proffer agreement.[1]

In a recorded proffer session in December 2008, during investigations into the 1997 killing of Christopher "The Notorious B.I.G." Wallace and possible drug charges, Davis told investigators he sat in the front passenger seat of the Cadillac, could not get a clear shot from his side, and passed the gun to the back seat, where Anderson took it and fired. "If we would have been on my side, I would have blasted," he said in the recording played for the jury.[13] Detectives had told him the statements could not be used against him.[13] In a 2009 recorded interview, also played at trial, he again named Anderson as the shooter.[12]

He later repeated his account in public: in a BET documentary series, which used his 2008 proffer recording, and in his 2019 memoir, *Compton Street Legend*.[11][23] In the memoir, he wrote that he slipped the gun into the back seat and the shots came from there.[23] In the book and his public interviews he did not say who fired.[3]

### Why it took 27 years

A former Las Vegas homicide detective testified that after a 2009 interview with Davis he intended to seek a murder warrant, but prosecutors at the time told him to stand down.[10] Wolfson said the case reached his office in 2009 and that charges were filed only when prosecutors believed they could prove it beyond a reasonable doubt.[4] Sheriff Kevin McMahill said, "Mr. Davis' own words reinvigorated our case in 2018."[25] Those admissions led to a July 2023 search of a Henderson home tied to Davis, where police said they took computers, a phone, a hard drive, .40-caliber bullets, a copy of his memoir and two tubs of photographs.[23][24] A retired detective told the grand jury the photographs included albums, magazines and clippings about the killing.[22]

### The indictment

A Clark County grand jury indicted Davis on one count of open murder with use of a deadly weapon, with a gang enhancement.[25][26] The indictment alleged he acted with "specific intent to promote, further, or assist the activities of the South Side Crips gang, with malice aforethought."[24] Police arrested him on Sept. 29, 2023, while he was out on a walk.[23] Chief Deputy District Attorney Marc DiGiacomo called him the "on-ground, on-site commander" who "ordered the death" of Shakur.[23] He pleaded not guilty.[14]

### Pretrial rulings

Davis's lawyers argued that his statements had been made under immunity agreements. Judge Kierny ruled that he had "no immunity from prosecution in Nevada" and declined to dismiss the case, noting that his book had led prosecutors to take the case to a grand jury.[17] His lawyers then asked the Nevada Supreme Court to order the case dismissed, arguing that the state had no evidence linking him to the killing apart from his own uncorroborated admissions.[16][1] On Nov. 4, 2025, the court denied the petition. It held that a motion to dismiss "is not the appropriate vehicle to challenge the sufficiency of the State's evidence," and that Davis "has not shown that any protections extended to subsequent law enforcement interviews" or that Nevada "was ever bound by such an agreement."[1]

### The trial

The trial opened Aug. 17, 2026.[14] Prosecutors called 24 witnesses and played hours of Davis's recorded interviews, documentary footage and jail calls.[2][11] In one jail call played for jurors, Davis said, "I have blood on my money."[11] A former FBI agent testified that Davis had served federal prison time on drug-trafficking charges; the judge told jurors to consider that only for credibility, motive and identity.[11] A retired police gang expert called Davis a "shot caller" ranked "as high as you can get," but acknowledged on cross-examination that there was no physical evidence placing him in Las Vegas that night.[11]

The defense called three witnesses, including a retired Las Vegas homicide detective who testified that he could not verify several details Davis had given police. On cross-examination, he testified that Davis named the same four men investigators already believed were in the Cadillac.[10] Davis did not testify.[10]

In closing, Chief Deputy District Attorney Binu Palal acknowledged that Davis's accounts had changed over the years but said he consistently placed himself in the Cadillac: "The core facts remain."[2] "Who fired is not the question," Palal told the jury. Under Nevada law, a person who helps another commit murder can be convicted of it.[2] Defense lawyer Michael Sanft told jurors, "They have nothing in this case that says that man was here in Las Vegas on Sept. 7, 1996."[3]

### The verdict

On Aug. 31, 2026, after less than three hours of deliberation, the jury found Davis guilty of first-degree murder with use of a deadly weapon.[4] Prosecutors then dismissed the gang enhancement. The AP reported the reason as witness logistics; Wolfson cited Davis's age and "difficulties in proving up the gang enhancement."[3][4] Wolfson said the remaining charge carries a minimum of 40 years under the law in effect in 1996.[4] The maximum is life without the possibility of parole.[6]

Knight, the only other survivor of the BMW, did not testify. DiGiacomo said Knight was not credible and had a Fifth Amendment privilege.[4]

## Personal backstory

### Early life

Davis was born in Watts, California, one of 12 children, and his family later moved to Compton.[27] His mother died in 1980, when he was 15.[27]

### Life before the case

Davis became a leader of the South Side Compton Crips.[27] In his memoir he described running "a multimillion-dollar drug empire nationwide." CBS News reported that he was imprisoned for drug dealing from 1985 to 1989.[27] He told The Guardian that at one point he was moving 300 kilos a month.[15] By his account in the memoir, he agreed to talk to authorities about the killing while facing federal drug charges, after they "promised they would shred the indictment and stop the grand jury if I helped them out."[23][27] Law enforcement witnesses testified that he was briefly a suspect in the killing of the Notorious B.I.G. before being ruled out.[3]

### Health

Davis wrote that he was diagnosed with colon cancer in 2014 and that it went into remission.[27] A recording of him discussing his cancer was played at trial.[11]

### In custody

Davis has been in custody since his arrest in 2023.[4][20] Judge Kierny set bail at $750,000 but refused to release him in 2024. She questioned whether the man offering to post bond, a music executive, was a "front" for someone else, and noted that the bond came with conditions that included the rights to Davis's life story; Nevada law bars convicted killers from profiting from their crimes.[21][20] "I have a sense that things are trying to be covered up," she said.[20]

In December 2024 he was involved in a fight with another inmate at the Clark County Detention Center. He told officers he was "standing his ground."[18] In September 2025 he was sentenced to 16 to 40 months for battery, with a concurrent 364 days for challenge to fight. He told the judge he had acted in self-defense: "They're charging me because of who I am."[19]

During the trial, Davis stood in court and blamed the prosecutor for his treatment in custody: "I get beat up by the cops, the guy attacked me in here, sent me to prison."[12] His son was in the courtroom for the verdict.[3]

### What he says now

Davis has said he was not in Las Vegas the night Shakur was shot.[12] In recordings played at trial, asked whether he would apologize to Shakur's family, he said, "No. No, I didn't do nothing."[11] After the verdict he told The Hollywood Reporter, "I'm innocent, man. They got an innocent man sitting in jail," and said, "I'm getting out on an appeal."[9]

## Where the parties stand

- Prosecution: Prosecutors say Davis, a gang "shot caller," obtained the gun and "went hunting" for Shakur and Marion "Suge" Knight in revenge for the beating of his nephew, and that he is responsible even though he did not fire.[2][4] District Attorney Steve Wolfson said, "The strength of our case was Mr. Davis," and that the office will defend the conviction on appeal.[5]
- Defense: Davis's lawyer argued there was no physical evidence placing him in Las Vegas that night and that his accounts were "dramatized bravado" told for money and notoriety.[3][10] Davis says he is innocent and expects to win on appeal.[9]
- Victim's family: In a statement after the verdict, Shakur's family said it was "elated and relieved," thanked the jury and said "this is not the end of the story."[8] The family said it would say more at sentencing.[3]
