Shane James Jr.

Charged with capital murder in the deaths of four people in Austin on Dec. 5, 2023, James went on trial in Travis County in October 2026 after a jury found him competent. His lawyers have given notice of an insanity defense. He is separately accused in Bexar County of killing his parents.

Why he's in the news

The Travis County trial was set to open with jury selection on Monday, Oct. 26, 2026, but Judge Cliff Brown granted a defense motion that turned that day into a competency trial.10 After two forensic psychologists testified, a 12-member jury deliberated briefly and found "insufficient evidence to find James incompetent to stand trial."78 Jury selection for the capital murder trial began the next morning, Oct. 27, with cameras barred during selection to protect jurors' identities.6 In opening statements on Oct. 29, the prosecution argued that James knew what he did was wrong, and the defense argued that he was legally insane.3 The state began calling witnesses that day, starting with the school district police sergeant who was the first person shot in Austin, and expects to call about 35 in all.43

The backstory

James has not been convicted. Everything in this section is an allegation by police or prosecutors, testimony at a competency trial, which decided only whether he is fit to be tried, or testimony at a trial that is still under way. Testimony is evidence for the jury to weigh, not a finding.683

Two jurisdictions

James faces two separate cases. In Travis County, he is on trial in the 147th Criminal District Court on capital murder charges in the deaths of four people in Austin and on charges in the shootings of three others who survived.141 In Bexar County, the sheriff’s office says he killed his parents before the Austin shootings, and it has issued a capital murder warrant in their deaths.1419 The two cases are described separately below.

Travis County: the Austin shootings

According to police and news reports drawn from them, the shootings in Austin took place over about eight hours on Dec. 5, 2023.2123

At about 10:45 a.m., an Austin Independent School District police sergeant was shot in the leg near Northeast Early College High School; the officer’s injuries were not life-threatening.2123

Just before noon, Emmanuel Pop Ba, 32, was shot and killed during what Austin police described as a carjacking on Shadywood Drive in South Austin.1421 Police said Sabrina Rahman, 24, saw that shooting from the porch of a nearby home and that James shot and killed her.14

Later that afternoon, a cyclist was shot on West Slaughter Lane and survived.2123

At about 6:49 p.m., according to an Austin Police Department release, a homeowner on Austral Loop in Southwest Austin saw on his security camera a man kick in his back door. An officer who arrived confronted a man in the backyard, gunfire was exchanged, and the officer was shot and injured. Inside the home, officers found Katherine Short, 56, and Lauren Short, 30, with gunshot wounds; both were pronounced dead at the scene.221 KXAN reported that Lauren Short was Katherine Short’s daughter.13 Police said the man fled in a vehicle stolen from the home and was arrested shortly afterward following a collision at FM 1826 and State Highway 45.2

KXAN has reported that authorities allege the four people in Austin were killed at random.6

The charges

At a news conference after the arrest, Austin police announced that James was charged with capital murder in the deaths of Emmanuel Pop Ba, Sabrina Rahman, Katherine Short and Lauren Short, and with aggravated assault in the shootings of the school-district officer, the Austin police officer and the cyclist.1 Jail records reported in the following weeks listed capital murder of multiple persons and capital murder by terror threat among the counts.2115 Interim Police Chief Robin Henderson described “a series of violent incidents” that ran from morning into evening.23

In August 2024, KSAT reported that James could face the death penalty if convicted.18 By May 2026, prosecutors had said they would not seek it.13 If he is convicted of capital murder, the sentence is automatically life in prison without the possibility of parole.96 He pleaded not guilty at a May 28, 2026 hearing.13

Statements attributed to James

According to arrest records reported by KENS 5, James told authorities that on the morning of the killings he was “feeling impending doom and it got worse.”20 According to court paperwork filed in Bexar County, as reported by FOX 7 Austin, he told investigators he “didn’t want his mother to suffer.”11 KVUE reported in October 2026 that court documents from Bexar County, made public in June 2024, showed that James had admitted killing his parents.10 These statements have not been tested in court.

Competency

In August 2024, James asked Judge Clifford Brown to let him represent himself, citing a disagreement with his lawyers; his lawyer, Russell Hunt Jr., said the defense had asked for a competency evaluation, which James refused.18 Hunt said: “It’s always a terrible idea for a person to represent themselves.” Brown told James, “I routinely tell people it’s not a good idea to represent yourself,” and said a competency evaluation would be needed either way.18 At a later hearing, James called the evaluation “unnecessary” and “baseless.”16

In October 2024, James was found incompetent to stand trial, according to court records; a writ of commitment was registered Oct. 30, and he was sent to a state hospital for treatment.101613 On July 9, 2025, a judge found his competency restored; Judge Leon Grizzard returned the case to the 147th District Court, according to Hunt.15 Hunt said then that experts could now begin an evaluation of James’s sanity at the time of the offenses, which could not start until he was competent.15

The trial was set for Oct. 26, 2026.14 Days before, Judge Brown granted a defense motion to turn that day into a competency trial.10 The defense argued that symptoms of schizophrenia prevent James from taking part in his defense.7 Two forensic psychologists testified that James has symptoms of schizophrenia, including auditory hallucinations and delusions, but disagreed on what that means for his fitness.87 Mollimichelle McClendon, called by the defense, testified that James described voices that “hated him” and delusions involving “laser masters”; she said he understands the charges and possible punishments but has “delayed thinking and impaired judgment,” and she believes the delusions impair his ability to work with his lawyers.78 Kimberly Harrison, the state’s forensic psychologist, testified that he communicates clearly and recalls details, and that his hallucinations are “manageable and have improved over time.”87 The jury deliberated only minutes before returning its verdict, shortly before 5:30 p.m.8

The insanity defense

On Sept. 23, 2026, James’s lawyers filed notice of intent to raise an insanity defense.11 Under Texas law, a defendant may be found not guilty by reason of insanity if, because of a severe mental disease or defect, he did not know at the time that his conduct was wrong; it is an affirmative defense that the defense must prove by a preponderance of the evidence.9 Jurors are to consider his mental state only at the time of the acts.6 Competency, decided on Oct. 26, and sanity at the time of the offenses are separate legal questions.7

The trial

Three panels of about 90 prospective jurors each were summoned; one was used for the competency trial, which was scheduled after the summons went out.6 Jury selection began Oct. 27, 2026.6 Judge Brown barred cameras during selection and will permit them during the trial.6

In his opening statement on Oct. 29, 2026, First Assistant District Attorney Rickey Jones told jurors, “He knew it wasn’t legal and he know it was wrong,” and said James had described writings on a wall as expressions of anger.3 Defense attorney Michael Watson told jurors that James’s schizophrenia, hallucinations and delusions are not in dispute, called the wall writings “a maze” of ramblings, cited emergency mental-health detentions in 2019, 2021 and 2022, and said, “He did not understand what was right and what was wrong.”3

The first witness was Austin ISD police Sgt. Val Barnes, who testified that he was shot that morning: “I already had blood coming from my face. Then I looked down, and I saw blood on my leg.”4 A forensic witness who examined several scenes testified that the shell casings matched, indicating that the same gun was used in several of the shootings.4 A woman working on Shadywood Drive testified that she heard what sounded like gunshots and began CPR on Sabrina Rahman.4

On Oct. 30, a paramedic, forensic witnesses and a deputy medical examiner testified about the Shadywood Drive and Austral Loop scenes and the autopsies of Emmanuel Pop Ba and Sabrina Rahman.5 A forensic scientist testified that a Nissan Versa held a backpack, a magazine, a box of ammunition and a résumé in a folder bearing James’s name, and that the Toyota Sequoia taken from Shadywood Drive had blood spatter; an Austin police officer who tracked the Sequoia testified that once the Austral Loop call came in, officers knew it was the same suspect.5 The defense cross-examined little; it brought out that no electronics in the cars were linked to James and suggested that abrasions seen in the autopsies could have come from lifesaving efforts.5

Bexar County: the deaths of Shane James Sr. and Phyllis James

According to court paperwork filed in Bexar County, Austin police contacted the sheriff’s office after James’s arrest on Dec. 5, 2023.11 Deputies forced entry into his parents’ home near Kirby that evening and found the bodies of Shane James Sr., 56, and Phyllis James, 55.1423 The Bexar County Medical Examiner’s Office said each died of a gunshot wound to the head.21 The sheriff’s office said the killings happened between the night of Dec. 4 and the morning of Dec. 5, before the Austin shootings.2123

In June 2024, Hunt disclosed at a Travis County hearing that Bexar County had filed a charge about two weeks earlier, and a sheriff’s office spokesperson confirmed an active capital murder warrant; the Bexar County District Attorney’s Office declined to comment because the case was pending.19 Hunt said: “So far, Bexar County is telling Travis County they want Travis County to take the lead.”19 In May 2026, KSAT reported that it found no 2023 charges against James in Bexar County’s online justice portal and that the sheriff’s office had not responded to a request for an update.14 No indictment, hearing or trial date in the Bexar County case was found in the sources reviewed.

Personal backstory

Early life and family

James was 34 at the time of his arrest and lived in his parents’ home in northeast Bexar County, according to news reports.2223 No sourced account of his childhood or schooling was found.

Military service

He served in the U.S. Army from February 2013 to August 2015, with no deployments, NBC News reported; an Army spokesman declined to give details of his discharge, citing privacy rules.2322 Sheriff Salazar said, “We know now that there was a domestic violence incident of some sort in the military,” and linked it to James’s leaving the Army.23

Earlier cases

Texas Department of Public Safety records show a 2017 misdemeanor criminal trespass conviction in Tarrant County, KSAT reported.22 In January 2022, he was arrested on three misdemeanor family violence charges after an incident at the family home; a sheriff’s office report, as described by KSAT, says he shoved his father and pushed his mother and a sibling.22 He was released in March 2022 on GPS monitoring that restricted him to mental health treatment sites, and he cut off the monitor the next day, according to KSAT; warrants were issued for his re-arrest.2223

Deputies responded to the family home at least 14 times between April 2016 and December 2023, KSAT reported, seven of them for disturbances, welfare checks or a mental health crisis.22 In late August 2023, deputies found him in a bedroom but left without arresting him on the misdemeanor warrants to avoid what Salazar called a possible “violent confrontation”; they asked his father to call back, and Salazar said that call never came.2223 Bexar County District Attorney Joe Gonzales said, “There was no crystal ball.”23

Mental health

Two forensic psychologists testified at the October 2026 competency trial that James has symptoms of schizophrenia, including auditory hallucinations and delusions.87 A court found him incompetent in October 2024 and restored to competency in July 2025, and a jury found him competent on Oct. 26, 2026.10157 His lawyer said in 2024 that he “does have a history of psychiatric disturbances.”16 No court has ruled on his sanity at the time of the shootings; that is a question for the trial jury.

In custody

He has been held in the Travis County Jail since his arrest, apart from his commitment to a state hospital.1321 The Travis County Sheriff’s Office said that shortly after his arrest he tried to escape by pushing past a corrections officer and was restrained.21 James has made no public statement about the case in the sources reviewed, beyond his remarks in court.

The victims’ families

No statement from the victims’ families was found in the sources reviewed.

Where the parties stand

Prosecution

The Travis County District Attorney's Office is not seeking the death penalty, and prosecutors do not intend to offer a plea deal, KXAN reported.13 At the October 2026 competency trial, the state's forensic psychologist testified that James's hallucinations are "manageable and have improved over time."7 The prosecutors handling the case were not named in the sources reviewed.

Defense

James has pleaded not guilty.13 On Sept. 23, 2026, his lawyers filed notice of intent to raise an insanity defense, meaning they will argue he was not guilty by reason of insanity.116 Before trial they sought a new competency determination, arguing that symptoms of schizophrenia interfere with his ability to take part in his defense; a jury disagreed.107 His court-appointed lawyer, Russell Hunt Jr., said in 2024 that James "does have a history of psychiatric disturbances" and that he would prefer "a negotiated outcome" to a trial.1619
