## The backstory

Robinson has not been tried. Everything in this section is an allegation by prosecutors or police, or testimony at a preliminary hearing, where the state needed to show only probable cause. None of it has been tested before a jury.[4]

### The shooting

Charlie Kirk, 31, a conservative activist and co-founder of Turning Point USA, was speaking at Utah Valley University in Orem on Sept. 10, 2025, the first stop of a speaking tour.[11][3] According to the charging documents as reported, he was shot at 12:23 p.m. while addressing a crowd.[13] Investigators say he was shot once in the neck while taking questions from a crowd of several thousand.[10] Prosecutors allege the shot was fired from a rooftop more than 400 feet away.[3]

### The investigation

According to the charging documents as reported, police found a bolt-action .30-06 rifle wrapped in a towel near the campus, and a university officer found markings on a roof "consistent with a sniper having lain on the roof."[13] The rifle was recovered in a wooded area, according to preliminary-hearing coverage.[10] Video allegedly shows a person with a rifle-like object going onto the roof and then fleeing.[13]

The charging documents say Robinson's mother recognized him in photos released by authorities, and that his parents believed the rifle matched one that had been given to him as a gift.[15] According to the documents, Robinson implied in a phone call that he planned to take his own life; his parents persuaded him to come to their home, where he implied that he was the shooter.[15] According to the charging documents as reported, a family friend who is a retired deputy persuaded him to surrender, and he did so at the Washington County Sheriff's Office.[13] He was taken into custody on the night of Sept. 11.[11]

### The messages and note

Prosecutors allege that on the day of the shooting Robinson texted his roommate, with whom he was in a romantic relationship, to look under his keyboard, where a note was found.[15] According to the charging documents, the note read: "I had the opportunity to take out Charlie Kirk and I'm going to take it."[15] Prosecutors say that when the roommate asked whether he was responsible, he replied, "I am, I'm sorry."[13] Messages quoted by prosecutors refer to retrieving a rifle he had left "wrapped in a towel," and ask the roommate to "delete this exchange," not to talk to the media and, if questioned by police, to "ask for a lawyer and stay silent."[16] Prosecutors also allege he wrote that he had "had enough of his hatred."[10]

### The charges

The Utah County Attorney's Office filed formal charges on Sept. 16, 2025.[2] The seven counts are aggravated murder, a capital felony; felony discharge of a firearm causing serious bodily injury; two counts of obstruction of justice; two counts of witness tampering; and committing a violent offense in the presence of a child, a misdemeanor.[13][5] Prosecutors also allege a victim-targeting enhancement, based on their claim that he selected Kirk because of what he perceived Kirk's political beliefs to be.[13] He is accused of disposing of the clothing he wore during the shooting and of directing his roommate to delete messages and not speak with investigators.[18]

County Attorney Jeff Gray filed a notice of intent to seek the death penalty minutes before Robinson's first court appearance.[14] Gray said he made the decision "independently as county attorney based solely on the available evidence."[13]

### The preliminary hearing

The preliminary hearing ran in Provo the week of July 6, 2026.[12] A state forensic witness testified that DNA on the towel wrapped around the rifle came from two people, one "very likely" Robinson; an FBI analyst also testified about the DNA results.[10] Prosecutors showed surveillance video that they say shows Robinson on the roof of a campus building for about 30 seconds.[9] Investigators also linked him through DNA to a tool allegedly used to engrave the cartridges, one of which bore the words "Hey Facist! CATCH!", which prosecutors call an "overt political reference."[3] According to investigators, he posted a message admitting the shooting in an online chat room about an hour before surrendering.[3] The court also heard a recorded interview with his roommate, who told investigators Robinson said the day after the shooting that he wished he had not done it.[3]

The defense called forensic experts to challenge the reliability of the DNA conclusions, and Robinson did not testify.[9][10] In written arguments, prosecutors called the case "as straightforward a bindover decision as this court will ever see."[8]

### The bindover ruling

The case is capital only if prosecutors prove an aggravating circumstance: here, that Robinson knowingly created a great risk of death to someone other than Kirk and himself.[5] Defense attorney Staci Visser argued: "There is one shot. There is one bullet. There is one victim."[3] Prosecutor Ryan McBride countered, "You can't shoot a rifle into a crowd of 3,000 people without knowing."[4]

On Sept. 1, 2026, Judge Graf found the evidence supports "a reasonable belief that the defendant is the individual who shot and killed Charlie Kirk," and bound Robinson over on all seven counts and the victim-targeting enhancement.[4] Graf said firing toward a crowded event was not enough by itself, but cited "the documented position of several individuals in and around the canopy area" where Kirk sat as supporting a reasonable inference that Robinson knew others were nearby.[5][3] He called the defense argument "substantial" and said it would be tested at trial.[4] Robinson's attorneys waived a formal reading of the charges and entered not-guilty pleas.[5]

### Other rulings

In February 2026, the defense sought to disqualify the entire Utah County Attorney's Office because many of its lawyers had family or friends at the university during the shooting; the judge denied the motion.[12] In April 2026, Graf allowed news cameras to remain in the courtroom but barred filming or photographing Robinson.[12]

## Personal backstory

### Early life and family

Robinson, 22 at the time of his arrest, is from Washington, Utah, according to the charging affidavit.[17] He has two younger brothers, the AP reported.[17] According to the charging documents, his mother told police that over the previous year he had become more political.[15] His parents attended the bindover hearing.[3]

### Schooling and work

He was an honor-roll student in high school, the AP reported.[17] He was admitted to Utah State University in 2021 on an academic scholarship and attended for one semester, a university spokesperson said.[17] At the time of his arrest, he was a third-year student in the electrical apprenticeship program at Dixie Technical College in St. George, according to the AP.[17]

### Record and voting

State and federal court records showed no prior criminal cases involving him, the AP reported.[17] State records showed he was registered to vote without a party affiliation and was listed as inactive.[17]

### Mental health

*No testimony, finding or on-record statement about Robinson's mental health was found in the sources reviewed.*

### In custody

At his first appearance, Graf found him indigent and appointed qualified counsel.[13] He was held without bail in the Utah County Jail after his arrest.[1][14] *Robinson has made no public statement about the case in the sources reviewed.*

## Where the parties stand

- Prosecution: Prosecutors say the evidence is "overwhelming," citing DNA, surveillance video, his messages and what they describe as repeated admissions.[3][8] They argue he knowingly endangered the crowd and selected Kirk because of his political views.[4]
- Defense: Robinson's lawyers have challenged the reliability of the DNA testing and argue that a single shot that struck only Kirk did not endanger others, the circumstance that makes the case capital.[10][3] They call the claimed political motive "an inference without evidence."[4]
- Victim's family: The Kirk family called the bindover "an important step in our family's pursuit of justice" and, through their attorney, has pressed the court for a prompt trial.[4][5]
